Changing or cancelling conditions on a resource consent

Conditions are imposed on resource consents to ensure that possible adverse environmental effects of a proposal are avoided, remedied or mitigated. You can apply to change the conditions.

Under section 127 of the Resource Management Act 1991, only the change to the condition can be considered. It does not provide for the reconsideration of the entire application.

A consent holder is able to apply for a change or cancellation of a condition of consent, except:

  • when a condition relates to the duration of a consent - see extending time.
  • after a survey plan has been deposited (for subdivision consents). However, if a condition of subdivision consent involved a "consent notice", you may be able to apply to vary or cancel the consent notice. We recommend you engage a surveyor in this instance.
