Extending time

The Resource Management Act 1991 (RMA) states that a resource consent will lapse if it has not been given effect to. The normal time allowed is five years.

You are able to apply for an extension to the lapse period, provided it is made before the lapse date. When considering the application Dunedin City Council has to consider:

  • If substantial progress has been made towards giving effect to the consent
  • If written approval from every person who may be adversely affected by the granting of the extension
  • What is the effect of the extension on the objectives and policies of the Dunedin City District Plan.

Deciding whether or not a consent has been given effect to is often not straightforward. If your consent is nearing the lapse date you may find it beneficial to talk to one of the Council's resource consent planners.
