The site has been subdivided and following the issue of new titles, the application site, (19 Eagle Street) will have a new legal description.

Resource consent is sought to establish a second dwelling with integral garage on the site at 19 Eagle Street (Lot 1). The dwelling encroaches into the front and side yards and breaches the height plane angle to the north eastern and south western boundaries. Earthworks involve approximately 96m3 of excavation and fill. The earthworks will result in cuts of up to 2.5m for the dwelling platform. A 2.0m maximum cut will be made on the north east boundary reducing to nil height over the length of the wall. The dwelling will result in 45% site coverage on Lot 1.  

As the title process is not completed, the application has also been assessed as if the site remains as being contained within one whole title.  Following issue of the titles, the proposed deck will result in an internal yard encroachment between the boundaries of Lot 1 (21 Eagle Street) and Lot 2 (19 Eagle Street).

The site is zoned Residential 1 under the Dunedin City District Plan and is assessed as a discretionary (restricted) activity under the Proposed 2nd Generation Plan (2GP).  The Proposed 2GP was notified on 26 September 2015, and some 2GP rules have immediate legal effect.  In this instance, there are no relevant 2GP rules to consider.
