| Application description | Resource consent is sought to establish a dwelling at 22 Cleghorn Street, Dunedin. An indicative plan of the dwelling and the building platform are included in the application, along with a Landscape Plan and an assessment of environmental effects. The site is zoned Rural and is within the Flagstaff-Mt Cargill Landscape Conservation Area (Visually prominent Area). The subject site is 8032m2, which does not comply with the minimum site size of 15ha per residential dwelling in the Rural zone. The proposal to establish residential activity on an undersized rural site is assessed as a non-complying under the Dunedin City District Plan. The Proposed Second Generation District Plan (“2GP”) was notified on 26 September 2015. Section 88A of the Resource Management Act determines that the activity status of the application (discussed above) remains unaltered. The majority of the proposed 2GP rules do not have immediate effect and at this time there are no relevant rules to consider. The 2GP objectives and policies must be taken into account. The above application is being processed pursuant to the Limited Notification provisions of section 95B of the Resource Management Act 1991. This means that notice of the application is being served on those parties that the Dunedin City Council considers may be adversely affected and have not given written approval to the activity.
