Application description

Resource consent is sought to vary resource consent LUC-2006-370735 to change conditions 1, 4 and 5 of the original approved consent.

Condition 1 of the consent required the approved activity to be in general accordance with plans and information submitted as part of the resource consent application. This condition is requested to be varied as the accessory building that was proposed to be used temporarily as a residential unit pending construction of a new dwelling is now being utilised as the permanent residential unit. An accessory building is proposed to be located where the new dwelling was proposed. The approved activity is no longer in accordance with the plans and details submitted due to the change of location and purpose of the approved buildings.

Condition 4 of the consent detailed the requirements for landscape development including specific timeframes in which the three stages of this development shall be completed. The works required to be undertaken, as of this date, have not been completed and it is requested to vary this condition to extend the timeframe that the works need to be completed within.

Condition 5 of the consent required the approval by Council’s Architecture and Urban Design Department of the proposed colour of any timber stain or paint to be applied to the weatherboards and the proposed colours and materials for the dwelling’s roof and the exterior surfaces of the accessory buildings. The application seeks to vary this condition to allow for the existing residential unit and the proposed accessory building to Grey Friars in colour and the accessory building to be clad in Endura Colour steel.

The site is zoned Rural and almost all the land is within a Landscape Management Area (Peninsula Coast Outstanding Landscape Area).

In accordance with the provisions of Section 127(3)(a) of the Resource Management Act 1991, the application to vary land use consent LUC-2006-370735A is a discretionary (unrestricted) activity.

The Proposed 2GP was notified on 26 September 2015, and some 2GP rules have immediate legal effect.  In this instance, there are no relevant 2GP rules to consider. The proposed zoning is Rural Peninsula Coast and part of the site is in the Peninsula Coast Outstanding Natural Landscape.
