• Deemed operative provisions

  All provisions with no mark up e.g. a clean white background are deemed operative provisions. For rules, this means no other versions of the rule need to be considered. An example is shown below:

  

• Proposed provisions with no legal effect 

  All proposed amendments which do not yet have legal effect are highlighted lime green and shown as marked up text (single underline for new content or single strike-through for removed content). These rules will not be applied yet and the unmarked version of the same rule is the only rule that will apply at this time. An example is shown below:

  

  

• Proposed provisions with legal effect 

  Proposed provisions that have legal effect under section 86B of the RMA are highlighted lemon. In these cases, both the new and the old versions of the rule applyand the most restrictive of the two will take precedence.  If the new rule requires a resource consent, this must be applied for. An example is shown below:

  

  

• Appealed provisions (rules with legal effect) 

  At the time of notifying Plan Change 1, no provisions are subject to appeal.  Should any provisions be subject to appeal through future appeals processes, these will be highlighted red.

  Appealed rules have legal effect meaning any rules must be complied with. In these cases both the new and the old version of the rule apply and the most restrictive of the two will take precedence. An example is shown below:

  

What is the status of 2GP rules and how do they apply?

From 19 August 2024, most rules in the 2GP are operative except:

• the mapping of some specific sites in the 2GP Planning Map, where they are still subject to appeal; and
• Plan Change 1 provisions, which are deemed operative unless otherwise indicated to be a proposed provision with no legal effect, a proposed provision with legal effect or an appealed provision with legal effect (as per the colour coding detailed above).

Where a site is still subject to an appeal (highlighted red in the 2GP Planning Map), both the new 2GP rules and the previous District Plan (2006) rules apply to that site until any appeals are resolved. Here are examples of what this means.

• For an activity that needs a resource consent under the previous District Plan but is permitted under the 2GP, a resource consent will still be required. However, the objectives and policies of the 2GP can be considered and may support the granting of that resource consent.
• For an activity that requires resource consent under both plans, but has different activity statuses e.g. restricted discretionary and non-complying, then the most restrictive activity status applies, i.e. non-complying in this example.
• For an activity that is permitted in the previous District Plan, but needs a resource consent under the 2GP, a resource consent will be required.

Some rules in Plan Change 1 have immediate legal effect from the date of notification pursuant to Section 86B(3) of the RMA. All other rules will have legal effect once a decision on submissions relating to the rules is made and publicly notified.

For resource consent applications, the activity status that applies is whatever the status is on the day an application is lodged. The activity status is the classification of the activity, e.g. restricted discretionary or non-complying.
