Pursuant to Sections 34A and and 104D, and after having regard to matters set out in Part II and Sections 104 of the Resource Management Act Act 1991, I hereby grant consent for a non-complying activity being the subdivision of the site legally described as Part Allotment 42 Deposited Plan 1824 (held in Computer Freehold Register OT164/192) subject to conditions imposed under sections 108 and 220 of the Act. The conditions are attached in a decision certificate.

47 Greenacres Street (LUC-2015-251)

The application to remove a scheduled tree at 47 Greenacres Street, Macandrew Bay, Dunedin was processed on a notified basis in accordance with sections 95A to 95G of the Resource Management Act 1991 (the Act). No submitters wished to be heard in respect of the application and therefore, pursuant to Secgtion 100 of the Resource Management Act 1991, the application was considered by the Resource Consents Manager, under delegated authority, on 24 August 2015. I advise that the Council has granted consent to the application.

155 Chain Hills Road, Taieri (SUB-2015-64 & LUC-2015-349)

The above applications for subdivision and land use were processed on a notified basis in accordance with Section 95 of the Resource Management Act 1991. The application was heard and considered at a hearing on 16 December 2015. The Committee granted consent to a reduced proposal on 27 January 2016 in a majority decision. The proposal as granted will allow the establishment of 2 sites and one additional dwelling on the proposed platform specified for Lot 2.

72 Newington Avenue Dunedin (LUC-2015-236)

This application to undertake earthworks and establish additional car parking areas at Mercy Hospital was processed on a limited notified process in accordance with Section 95 of the Resource Management Act 1991. The Consent Hearings Committee heard and considered the application at a hearing on 23 October 2015. The Committee granted consent tot he application on 18 November 2015. In granting consent it has required changes be made to the design of the lower car parking area to retain two additional trees.

123 Brockville Road (LUC-2015-415)

Your application to remove trees scheduled in the Dunedin City District Plan was processed on a notified basis In accordance with sections 95A to 95G of the Resource Management Act 1991 (the Act) . No submitters wished to be heard In respect of the application and therefore, pursuant to Section 100 of the Resource Management Act 1991, the application was considered by the Resource Consents Manager, under delegated authority, on 26 November 2015. Iadvise that the Council has granted in part consent to remove trees within the tree group G023. Removal of the four trees closest to Brockville Road is approved while the two trees at the rear of the site are to be retained.

241 SIgnal Hill Road (LUC-2015-333 )

Your application for the establishment of residential activity in a new residential dwelling on an undersized Rural-zoned site at 241 Signal Hill Road, Dunedin, with a front yard breach of 10.0m along the southeast front boundary in the location of the nominated building platform only, was processed on a notified basis in accordance with sections 95A to 95G of the Resource Management Act 1991. No submitters wished to be heard in respect of the application and therefore, pursuant to section 100 of the Resource Management Act 1991, the application was considered by the Resource Consents Manager on 21 December 2015. I advise that the Council has granted consent to the application.

Your application for land use consent to establish a second residential unit for family members on the above site was processed on a notified basis in accordance with sections 95A to 95G of the Resource Management Act 1991 (the Act). There were no submissions in respect of the application and therefore, pursuant to Section 100 of the Resource Management Act 1991, the application was considered by the Resource Consents Manager, under delegated authority, on 27 January 2016. I advise that the Council has granted consent to the application.

The above application for a two lot subdivision and landuse consent for the consequential use of the existing dwelling on Lot 1 and also landuse consent for a new dwelling on Lot 2, was processed on a Notified basis in accordance with Section 95 of the Resource Management Act 1991. That, pursuant to Sections 34A and 104C and after having regard to Part 2 matters and Section 104 of the Resource Management Act 1991, the Dunedin City Council declines consent to the non-complying activity to subdivide 326 Factory Road, Mosgiel into a proposed Lot 1 of 2.9021 hectares and a proposed Lot 2 od 2.1013 hectares on the site at 326 Factory Road, Dunedin, being that land legally described as Lot 2 DP12108 and Section 41 Block 5 East Survey District held in Certificate of Title CT51980

2 Townleys Road Burnside (LUC-2014-66)

[1] Your application to remove five significant trees at 2 Townleys Road was processed on a notified basis in accordance with sections 95A to 95G of the Resource Management Act 1991 (the Act). No submitters wished to be heard in respect of the application and therefore, pursuant to Section 100 of the Resource Management Act 1991, the application was considered by the Resource Consents Manager, under delegated authority, on 22 April 2014. [2] I advise that the Council has granted consent to the application.

17 Stephen Street Dunedin (SUB-2014-33)

The above application for resource consents to subdivide and establish an additional residential activity and on the above site was processed on a limited notified basis in accordance with Section 95C of the Resource Management Act 1991 (the Act). The Hearings Committee, comprising Councillors Andrew Noone (Chairperson), David Benson-Pope and Commissioner Colin Weatherall, heard the application at a hearing on 1 July 2014. The public part of the hearing was completed on this date. At the end of the public part of the hearing, the Committee, in accordance with section 48(1) of the Local Government Official Information and Meetings Act 1987, resolved to exclude the public. The Committee granted consent to the application following a site visit on 1 July 2014.

12 City Road Dunedin (LUC-2014-490)

Your application for land use consent to alter an existing dwelling and establish a double garage was processed on a limited notified basis in accordance with Sections 95A to 95G of the Resource Management Act 1991 (the Act). It was determined that any adverse effects would be no more than minor and that there were no special circumstances in relation to the proposal. However, not all affected parties provided written approval to the proposal and it was processed via limited notification. One submission was received in support of the application. It was determined that a hearing, pursuant to section 100 of the Act, was not necessary because the submitter did not wish to be heard and all other affected parties had provided written approval to the proposal. The application was considered by the Resource Consent Manager, under delegated authority, on 13 November 2014. I advise that the Council has granted consent to the application.

28A Heriot Row Dunedin (LUC-2014-157)

398 Cumberland Street Dunedin (LUC-2014-202)

The application for land use consent to reduce the gross floor area of an existing retail activity on the site was processed on a notified basis in accordance with sections 95A to 95G of the Resource Management Act 1991 (the Act). I advise that Council has granted consent to the application.

245 Saddle Hill Road Saddle Hill (LUC-2014-154)

The above application for resource consent to remove a scheduled tree was processed on a notified basis in accordance with section 95A of the Resource Management Act 1991. Following a site visit and initial deliberations on 27 June 2014, the Committee requested clarification as to whether the tree was located at 245 Saddle Hill Road or on the road reserve. The Committee advisor confirmed that the tree was located on the road reserve. After reconvening deliberations on 4 July 2014 the Committee declined consent to remove tree T1003.

160 Old Brighton Road Fairfield (SUB-2014-90)

Resource consent is sought to subdivide an existing 4.74 hectare lot at 160 Old Brighton Road, Fairfield into two lots and to establish a residential activity on proposed Lot 1. Pursuant to section 104D of the Resource Management Act 1991, and after having regard to Part II matters of the Act, I recommend that consent is granted to G R Duthie for a non-complying activity to subdivide the site into two resultant Lots at 160 Old Brighton Road, Fairfield, legally described as Lot 17 DP 24109, held in Computer Freehold Register OT16A/956, subject to the conditions imposed under sections 108 and 220 of the Act shown below.

116 Wingatui Road Mosgiel (LUC-2014-434)

The above application to remove a scheduled tree T061 was processed on a notified basis in accordance with Section 95 of the Resource Management Act 1991. The Committee has granted consent to the application on 5 November 2014 in a majority decision.

282 Taieri Road Dunedin. (LUC-2014-68)

The above application for resource consent to remove a scheduled tree was processed on a notified basis in accordance with section 95A of the Resource Management Act 1991. Following initial deliberations on 30 April 2014, the Committee resolved to seek an independent arborists report as there was conflict in the arboricultural evidence it had received. The report was provided to the Council on 27 May 2014. After reconvening deliberations on 29 May 2014 the Committee granted consent to remove tree T1073.

17 Duff Place Mosgiel (LUC-2014-38)

Your application to remove a significant tree was processed on a notified basis in accordance with Sections 95A to 95G of the Resource Management Act 1991 (the Act). Pursuant to section 34(1) and 104B, and after having regard to Part II Matters, and Section 104 of the Resource Management Act 1991, the Dunedin City Council grants consent to the discretionary activity being the removal of one Phoenix canariensis. (Phoenix Palm) tree (T381) located at 17 Duff Place, Mosgiel on the site legally described as Lot 18 Deposited Plan 10368 held in Computer Freehold Register OT3A/1193.

3 Butts Road Dunedin,145 Anzac Avenue Dunedin (SUB-2014-66)

The subdivision proposal creates four new allotments, which includes a boundary adjustment with the adjoining quarry. The land use application seeks the establishment of 19 new residential units of varying sizes and the continued use of the Hospital building for residential purposes. That pursuant to section 34A(1) and 104B and after having regard to Part II matters and sections 104 and 104B of the Resource Management Act 1991, the Dunedin City Council grants consent to a non-complying activity being the subdivision of the land at 3 Butts Road, Dunedin.
