Plan change - DIS-2021-1 (Variation 2)

The Dunedin City Council has been working on changes to the Second Generation Dunedin City District Plan (2GP) to provide for more housing.

Summary

Variation 2 is a change to the proposed District Plan (2GP) which includes a suite of changes to enable additional housing capacity through specific rule and policy changes and through rezoning specific sites.

Variation 2 was initiated due to housing capacity monitoring identifying a likely shortfall in housing capacity over the medium term (10 years).

Variation 2 will provide for additional housing capacity to ensure we don’t have a shortfall in the medium term, while ensuring enabled growth will not exceed the capacity of 3 waters networks and achieves good urban design outcomes.

Variation 2 is not a full review of the 2GP’s residential section’s rule framework or zoning across the city. A more comprehensive updated plan for the next 30 years will be developed separately as part of the next Spatial Plan, which will be jointly prepared with the Otago Regional Council (ORC).

3 Waters upgrades to support the additional residential capacity proposed in Variation 2 have been included in the Dunedin City Council’s 10-year plan.

All four hearings have now been held.

The Hearing Panel issued its first decision report on the matters addressed at Hearings 1-3 (changes to provisions and the intensification rezoning areas) on Tuesday 31 May 2022, and its second decision report on the matters addressed at Hearing 4 (greenfield rezoning sites) on Wednesday 8 February 2023.

Summary

On 8 February 2023 the second decision on Variation 2 was released, which covered the matters considered at Hearing 4. Hearing 4 primarily considered submissions on the proposed greenfield rezoning sites that were notified in Variation 2 and submissions on sites that were subject to a preliminary assessment in the plan evaluation report (s32 report), but rejected for various reasons, which were also open for submissions.

The decision report gives the Hearing Panel’s decisions on greenfield rezoning and associated provisions, and the reasons for their decisions. The report is accompanied by two appendices:

  • Appendix 1 - a marked-up version of the 2GP which shows the changes made to provisions as a result of decisions.
  • Appendix 2 – showing most mapping amendments made in response to submissions.

Approval of extension of time

The Dunedin City Council notified Variation 2 to the 2GP on the 3rd of February 2021, and under the Resource Management Act was required to give its decision no later than 2 years after notification.

On 26 January 2023 DCC lodged an application to the Minister for the Environment for an extension of time until 10 February 2023 to issue its final decision report on Variation 2. The Minister granted the extension of time as detailed in the letter below.

DCC notified the second and final decision on Variation 2 on 8 February 2023.

Status of amended provisions

Once decisions have been released, all Variation 2 provisions, including zoning changes, will have legal effect.

Legal effect means both the new Variation 2 provisions and rezoning areas (8 February 2023) and the partially operative 2GP (as at 7 February 2023) apply.

If there are no appeals against the new Variation 2 provisions (or any closely related provisions), these are deemed operative and replace the relevant existing rules in the partially operative 2GP. However, if a provision (or closely related provision) is appealed, both the provisions of this Variation 2 decision and the partially operative 2GP (as at 7 February 2023) apply until the appeals have been dismissed, withdrawn or determined by the Environment Court.

  • Summary

  • Scope of Variation

    The variation is subject to the RMA Schedule 1 process for making submissions, further submissions and the ability to appeal decisions.  However, the variation is limited in scope and it is not proposed to re-open it to submissions and decisions on aspects of the 2GP that are beyond the scope of the variation summaries listed in the Section 32 Report.

    Those wishing to make submissions on aspects of this variation should restrict their submission to the scope of the variation as detailed in the Section 32 Report and Summary of Changes documents.

  • Status of rules

    When are the Variation 2 changes expected to be in place?

    Provisions in Variation 2 will have legal effect at different times:

    • Objectives and policies have immediate legal effect from the date of public notification of Variation 2 (3 February 2021) and must be considered alongside the current 2GP provisions;
    • Council has passed a resolution to prevent rules protecting or relating to water, air or soil (for soil conservation), or protecting areas of significant indigenous vegetation, significant habitats of indigenous fauna, or historic heritage; or which provide for or relate to aquaculture activities having immediate legal effect from the date of public notification of Variation 2.  This has been done for clarity, and the resolution is likely to be rescinded when decisions on submissions are released.  This will enable all rules in Variation 2 to have legal effect at the same time;
    • The remainder of the rules in Variation 2 will not have legal effect until either:
      • the initial submission period ends and there are no submissions in opposition; or
      • decisions on submissions have been made.

  • Proposed Amendments

    What changes are being proposed?

    The proposed changes include:

    • zoning changes for some sites which will result in:
      • new greenfield sites for development in areas that were zoned rural or rural residential
      • more areas of medium-density zoning (where the density of housing can be increased)
    • rule changes for most of suburban Dunedin that will:
      • make better provision for social housing
      • remove the restrictions on who can live in family flats
      • allow smaller site sizes and provide for duplexes
      • create more flexibility for development through changes such as making it easier to average out site sizes in subdivisions
      • improve how the plan manages the development of areas rezoned for new houses (greenfield sites) to encourage good urban design and well-managed infrastructure.

    Most Dunedin residents live in areas which would be affected by one or more of these proposed changes.

    Why is Variation 2 not allowing consideration of zoning across the city?

    The 2GP is still in the appeal phase and re-opening large parts of the plan to a new variation will slow the progress towards making the plan fully operative. Until the 2GP is operative, parts of the 2006 District Plan continue to apply along with the 2GP provisions, which increases the complexity and costs of processing consents.  The changes proposed in Variation 2 are therefore as focussed as possible, and scope has been deliberately limited to avoid re-consideration of a wide range of provisions.

  • Planning maps

    Planning maps - the planning maps have been updated to show the areas affected by the proposed changes

    The 2GP Planning Map has been updated to include a new mapping layer called ‘Variation 2’. This layer shows the changes set out in the Section 32 Report Appendices: Appendix 10 – 2GP Map Amendments.

    The zoning changes generally relate to rezoning to either General Residential 1, General Residential 2, Township & Settlement, Large Lot Residential 1 or Recreation zoning, and the introduction or removal of new development, structure plan, stormwater constraint, wastewater constraint, or no DCC reticulated wastewater mapped areas.

    The Side by Side map (which is for information only and is not the official 2GP map) has been updated so you can view the current 2GP zoning versus the proposed zones and overlays.

  • Online version

    New provisions proposed by Variation 2 and existing provisions that contain proposed Variation 2 changes are highlighted in lime green. The proposed amendments are shown as marked up text as follows:
