Parking infringements

Parking infringements may be issued for a number of reasons, such as exceeding time limits or not paying for parking.

It’s important to remember to update your vehicle’s address on the Motor Vehicle Register every time you move to ensure your infringement or reminder notices reach you, as otherwise they will be sent to the Courts.

If you receive a parking infringement there are several options available to you:

Pay a parking infringement

Parking infringements can be paid:

Parking infringements must be paid in full within 28 days from the date of issue. After 28 days have passed, a reminder is sent out. If the infringement is not paid by the due date in the reminder, collection is handed over to a debt collection agency before being referred to the Fines and Collections   Unit of the Department for Courts. Once your infringement is lodged with the Court, you will also incur court costs and it will have to be paid through the Court’s system.

Disputing, transferring or requesting a court hearing for parking infringements

If your vehicle has been issued with a parking infringement and you would like to dispute the infringement, transfer liability for the infringement, or request a court hearing, you will need to know the following information which can be found on the ticket:

  • Registration number
  • Make and model of vehicle
  • Date and time the infringement occurred
  • The location that the infringement took place
  • The alleged offence
  • The fee incurred.

We will assess your explanation and decide whether your infringement can be cancelled.

Transfer liability of a parking infringement

Vehicle owners are liable for infringements occurred against a vehicle. If you were not the driver of the vehicle at the time, you may be able to transfer liability to the person who was driving.

To have liability for a parking infringement transferred to another person, you’ll need to provide a statutory declaration, details of the infringement, and any supporting documents you may have in support of your request.

  • Step 1: Fill out a statutory declaration

    Fill out the statutory declaration with information explaining why you are not liable for this infringement, e.g. if your car was stolen or you recently sold it.

    Before you sign the form, you need to find an authorised witness.

  • Step 2: Get the statutory declaration witnessed

    You will need to sign the form and fill in the date and place before an authorised witness, which includes a lawyer, a Justice of the Peace (JP), a notary public, a Court Registrar or Deputy Registrar, or a Member of Parliament.

  • Step 3: Gather supporting evidence

    If you have documents to support the facts in your declaration you can include these in your request to transfer liability.

    Supporting documents could include:

    • A police report if your car was stolen.
    • A NZ Transport Agency Waka Kotahi (NZTA) transfer receipt/sale agreement if you sold your car before the infringement took place.

  • Step 4: Submit your statutory declaration

    You can submit your statutory declaration and supporting documents to the DCC in one of the following ways:

Request a court hearing

You can request a court hearing if you want to:

  • Admit liability for the offence(s) and provide submissions for consideration by the court; or
  • Plead not guilty and request a defended court hearing.

A court hearing can only be requested once the reminder notice has been received in your name. Only the registered owner of the vehicle, the person named on the reminder notice or an authorised representative of a company or incorporated body, can request a hearing.

If you have received an infringement notice as the registered owner of the vehicle but you were not the driver of the vehicle at the time of the infringement and wish to transfer liability for the infringement to someone else, you must first complete the statutory declaration form. A new reminder notice will then be issued in the name of the driver, who can then request a court hearing if they wish.

Your request must be made before the due date on your reminder notice. The DCC cannot action a hearing request if the infringement has been paid or transferred to the Fines Collection Unit of the Ministry of Justice.

If you request a court hearing and plead guilty or are found guilty of the offence, the court may order you to pay the fine and any other costs.

Admit liability for the offence(s) and provide submissions for consideration by the court

Sending a written submission means that you do not appear in court. This option is only available if you wish to admit liability but feel you have a good reason that may excuse you. Your written submission and any previous correspondence will be forwarded to the court on your behalf. If you have additional supporting documents, include it with your request for a court hearing.

Two Justices of the Peace will consider your submission and you will be notified of their decision by mail.

Plead not guilty and request a defended court hearing

You can request a defended hearing if you believe you are not guilty. This hearing requires you to appear in court.

You will be given a date to appear in court and when called you will have to enter your plea. Should you plead guilty the matter will be finalised on the day. If you plead not guilty, a defended hearing will be set for another date.

If you have any witnesses you want to appear on your behalf, please make sure they are at court on the day of the defended hearing.
