What is a District Plan

What is a District Plan?

The Dunedin City District Plan controls what people can do on their land and how it can be developed. It includes objectives, policies and rules. The main goal of the District Plan is to sustainably manage the natural and physical resources of Dunedin to meet the needs of current and future generations and to provide for their social, economic and cultural wellbeing and for their health and safety.

What is the 2GP?

Under the Resource Management Act 1991, we have to start a review of our District Plan every 10 years. The current District Plan was first released in 1995 and became fully operative in 2006. A full review of the current Plan was started in 2012. This review has produced a Proposed Second Generation Dunedin City District Plan, which we are calling the 2GP. The 2GP is an entirely new Plan, with a new format, new zones, objectives and policies, and many changes to the rules.

On 19 August 2024 the 2GP was made partially operative except for appealed provisions.

When do provisions apply?

Different parts of the 2GP apply in different ways from 26 September 2015.

  • From 26 September 2015 the objectives and policies of the 2GP have to be considered alongside the objectives and policies of the current district plan (i.e. for these types of provisions both plans are used). This may change how resource consents are considered.
  • Some rules in the 2GP had legal effect from notification, but now all rules in the 2GP have legal effect as decisions on the 2GP have been released
  • Rules that did not receive submissions in opposition during the submission period are now deemed operative. These rules have been highlighted in green on the ePlan and outlined in the Deemed Operative Report. Please note that some provisions that were originally considered to be ‘deemed operative’ have subsequently been amended by more general submissions, and those provisions are therefore no longer considered to be ‘deemed operative’.
  • All other rules in the current district plan will only stop applying (and the rules in the 2GP replace them) when:
    • all submissions in opposition and appeals have been determined by the Environment Court; or
    • all submissions in opposition have been withdrawn or all appeals have been withdrawn or dismissed.
