Location of site 119 Edinburgh Street and 20 Rothesay Street, Waikouaiti. The land is comprised in three Computer Freehold Registers, being OT9B/1129, OT30/204 and OT25/120 and is legally described as Sections 6 – 22 Block XLVI. The former address has an area of 1.1132 hectares and contains an existing dwelling and accessory buildings, while the latter address has 0.6072 hectares in two titles and is currently vacant.

Application description

Resource consents are sought to subdivide the above addresses, establish a new dwelling on new Lot 2 and continue the residential activity on new Lot 1. The subdivision component is a reconfiguration of the common boundaries between the two sites, with the number of titles reduced from three to two. Lot 1 will have an area of 1.21 hectares, while Lot 2 will have an area of 5060 square metres.
The sites are zoned Rural in the operative Dunedin City District Plan and Rural Residential 1 in the Proposed Second Generation District Plan (“the Proposed Plan”). Rural zoned sites in the operative Dunedin City District Plan are required to be a minimum of 15 hectares. Residential activity on sites smaller than 15.0 hectares is a non-complying activity pursuant to Rule 6.5.7(i) of the operative Dunedin City District Plan and it is the new residential activity proposed for Lot 2 that is of importance in this case.
The Proposed Second Generation District Plan (“the Proposed Plan”) was notified on 26 September 2015. In respect of the proposed Rural Residential 1 zone, no relevant rules were given immediate legal effect pursuant to section 86D of the Resource Management Act 1991 at the time of notification. Accordingly, the Proposed Plan rules do not need to be considered alongside the operative Dunedin City District Plan rules.
The application includes an assessment of environmental effects.
