This notice relates to changes to rules made under Plan Change 1 to the 2GP that are associated with stormwater open watercourses. These changes were considered in ‘Stage 2 – Other Topics’ of Plan Change 1.
Section 86B(3)(a) of the Resource Management Act provides for rules that protect or relate to water to have immediate legal effect from the notification of a proposed plan.
On 24 September 2024 the Council resolved to delay the proposed changes to rules related to stormwater open watercourses from having immediate legal effect until the plan becomes operative.
This decision was rescinded by the Council on 12 August 2025. Rule changes proposed under Plan Change 1 that are being addressed in Stage 2 (All Other Topics) will now have legal effect on the day decisions on submissions addressed in Stage 2 (All Other Topics) are notified (being Wednesday 29 October 2025).
