The decision made by councillors at the November 2024 meeting to seek feedback as part of the Nine Year Consultation process on whether 231 Stuart Street should be removed from the list of strategic assets was made following incorrect information supplied to them by Property Services. Point 16 of the report presented by Property Services to the meeting under Condition of Building states the building requires "an updated seismic assessment". DCC Earthquake-prone Building Compliance Officer Peter Brookland has said the building does not require one. Discussion at the meeting centered on the requirement for earthquake strengthening which councillors believed would be too expensive for the DCC. If the correct information had been supplied at the meeting by Property Services then councillors may have voted differently. Due to this, if council do not rescind the November decision it leads to the possibility of a judicial review or an Ombudsman investigation.
